OFFICIAL RULES AND REGULATIONS
NO PURCHASE NECESSARY

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. NON-PURCHASE ENTRIES AND PURCHASE ENTRIES HAVE AN EQUAL CHANCE OF WINNING.VOID WHERE PROHIBITED OR RESTRICTED BY LAW. To enter the Safeway “Experience the Flavors of Chile” Sweepstakes (the “Sweepstakes”), each entrant must be a legal resident of the U.S. or Canada, residing in a participating Safeway Inc. Division, as defined below. To be eligible, entrants must also be 18 years of age or older as of February 2, 2005.

NorCal: Northern California (Excluding: Imperial, Inyo, Kern, Los Angeles, Orange, Riverside, San Bernardino, San Diego, San Luis Obispo, Santa Barbara, Tulare and Ventura counties), Western Nevada (Covering: Clark, Elko, Lincoln, Nye and White Pines Counties), Hawaii and Pak’n Save Stores.

Vons: Southern California (Covering: Imperial, Inyo, Kern, Los Angeles, Orange, Riverside, San Bernardino, San Diego, San Luis Obispo, Santa Barbara, Tulare, Fresno, Madera, Mono , and Ventura counties). Nevada (Covering: Clark county).
Pavilions stores: Southern California (Covering: Los Angeles, Orange, San Bernadino, Ventura and Riverside counties).

Seattle: Washington (Excluding: Clark, Wahkiakum, Cowlitz, Skamania and Klickitat Counties), Idaho, Montana, Milton-Freewater, Oregon, Kenai, Kodiak, Juneau, Fairbanks, North Pole and Soldotna, Alaska.
Carrs stores: Anchorage, Eagle River, Ketchikan, Palmer and Wasilla, Alaska.
Eagle stores: Homer, Big Lake, Seward, Valdez, Nome and Kotzebue, Alaska.

Phoenix: Arizona and Gallup, New Mexico.

Dominick’s: Illinois. Eastern: Maryland, Virginia, Delaware and Washington DC. Genuardi’s: New Jersey and Pennsylvania. Texas: Randalls stores: Houston and Austin, Texas. Tom Thumb stores: Dallas, Texas.Canada: Provinces of British Columbia, Alberta, Saskatchewan, Manitoba and Ontario.

2. TO ENTER: Simply use your Safeway Club Card, VonsClub, ValuePlus, Fresh Values Card, Randalls Remarkable Card, Tom Thumb Reward Card, CarrsPlus or Genuardi’s Club Card (“Club Card”) to purchase Chilean Grapes, Peaches, Plums, Nectarines or Kiwi at a participating Safeway, Pak’n Save, Vons, Pavilions, Randalls, Tom Thumb, Carrs, Eagle, Dominick’s or Genuardi’s Foods store in one of the above Divisions during regular store hours, from February 2, 2005 through February 15, 2005. Your entry is automatic. If you do not have a Club Card you may apply for a free card at the Customer Service Desk at any participating store. If you do not have your Club Card with you, you may use your home telephone number to enter. For such entrants, the entry will be made to the primary cardholder of the Club Card number within the user’s household associated by the common phone number in Safeway’s system. Neither Safeway Inc., Chilean Fresh Fruit Association (“Sponsors”), Don Jagoda Associates, American Airlines their respective parent companies, subsidiaries, affiliates, and the directors, officers, employees or agencies, nor any of their respective partners, (collectively, the “Sponsor Affiliates”) are responsible for electronic network, scanner or computer hardware or software malfunction and/or transmission failure, loss or delayed or corrupted data transmissions, or any technical or human failures, errors or difficulties of any kind.

3. ALTERNATE ENTRY METHOD: If you do not wish to make a purchase, you may also enter the Sweepstakes by hand-printing your name, Club Card number (optional), age, complete address, including zip code, home telephone number and store name on a plain 3” x 5” card and mailing your entry in a stamped envelope to: Safeway “Experience the Flavors of Chile” Sweepstakes, 601 University Avenue #275, Sacramento, CA 95825. Mail-in entries are limited to 1 entry per envelope. Each entry must be hand-printed, postmarked by February 15, 2005 and received by February 22, 2005. Neither the Sponsors nor the Sponsor Affiliates are responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated, or postage due mail. Photocopied, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. Mail-in envelopes larger then a #10 envelope will be automatically disqualified. All entries become the property of the Sponsors and will not be returned.

4. GRAND PRIZES AND APPROXIMATE RETAIL VALUE: Nine (9) trips (one (1) prize per division) – A seven (7)-day/six (6)-night trip for two (2) to Santiago, Chile in 2006. Trip includes round trip coach air transportation for two (2) from the U.S. to Santiago, Chile, and double occupancy hotel accommodations at the Marriott Santiago for four (4) nights and double occupancy hotel accommodations at the historic Hacienda Los Lingues for two (2) nights (based on availability). All travel must be completed by December 31, 2006. (ARV up to $6,200 U.S. each. In Canada, ARV may differ due to fluctuations in the dollar exchange rate and different retail prices for comparable items.). The Sponsors reserve the right to substitute the prize (or portion of prize) with prize of comparable or greater value if the prize cannot be awarded as described for any reason. Total approximate Grand Prize value is up to $55,800.

5. WINNERS: One winner per division will be selected in a random drawing, on or about March 1, 2005, from among all eligible entries received from each division. The drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization, whose decisions are final and binding on all matters relating to this Sweepstakes. Odds of winning are dependent upon the number of eligible automatic and mail-in entries received per division. Potential Grand Prize winners will be notified by phone and/or UPS. Winners must comply with all Sweepstakes rules as published. Potential Grand Prize winners will be required to sign and return an Affidavit of Eligibility and Release of Liability/Publicity before prize is awarded. Potential Grand Prize winners who reside in Canada will be required to sign and return a Declaration of Compliance with The Official Rules/Release of Liability/Publicity Release (“Declaration”) before prize is awarded. The Declaration will also contain an arithmetic skill-testing question that the winners must correctly answer unaided as a condition to receiving their prizes. Winners are required to return documents within 7 days from the postmark date on the prize notification letter. Failure to comply with this requirement or return of prize notification as undeliverable will result in forfeiture of prize and an alternate winner will be selected. Limit one prize per person/family/household.

6. CONDITIONS OF PARTICIPATION:THE FOLLOWING TERMS & CONDITIONS APPLY: Neither the Sponsors nor the Sponsor Affiliates assume any responsibility for incorrect or inaccurate capture of entry information, including, but not limited to, technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof. In the event this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsors reserves the right to cancel, terminate, or suspend the automatic portion of the Sweepstakes and in such event, to select winners for any remaining prizes by random drawing from among all valid automatic entries received, up to such time of cancellation, termination or suspension and all eligible mailed entries received. Entrants agree to be bound by these Official Rules and the decisions of the judges. All aspects of the prizes are NON-TRANSFERABLE and no substitutions are allowed except at the Sponsors’ sole discretion. Grand Prize winners and respective travel companions must travel together on the same itinerary, including the same departure date, destination and return date, and must have valid travel documents (i.e., valid passport, visa and photo ID) prior to departure. A portion of travel may be operated by (a) American Eagle, American’s regional airline affiliate; or (b) AmericanConnection® service, which is operated by Trans State Airlines, Inc., Chautauqua Airlines, Inc. or Corporate Airlines, Inc., each of which operates as an independent contractor. Travel must originate and end at the airport nearest winner’s home that is served by American Airlines. If winner is unable to travel by date indicated, prize will be forfeited. Flight schedules are subject to change without notice. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. The Sponsors and the Sponsor Affiliates are not liable for any expenses incurred as a consequence of flight cancellation/delay. Winners’ travel companions (or parent/legal guardian if a travel companion is a minor in his her State/Province of residence) must execute a Release of Liability/Publicity Release (except where prohibited by law) prior to departure. Winners and travel companions are solely responsible for obtaining valid passports/visas and any other required travel documents or requirements prior to travel, failure to do so will result in forfeiture of prize. Certain restrictions and blackout dates may apply. Seat selection and timing of trip subject to availability and confirmation of reservations. No cash equivalent or exchange of prize is permitted (except at the Sponsors’ sole discretion). Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Grand Prize Winners are solely responsible for any local, state, province or federal taxes resulting from winning and accepting a prize. All incidentals, meals, beverages, gratuities, travel expenses, taxes, ground transportation and other expenses not specifically set forth herein are the responsibility of the winners.

7. ELIGIBILITY: The sweepstakes is only open to legal residents of the U.S. or Canada, residing in a participating Safeway Inc. Division, as defined in paragraph 1. To be eligible, entrants must also be 18 years of age or older as of February 2, 2005. Employees of the Sponsors, the Sponsor Affiliates or any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or same household of each are not eligible to participate. Safeway “secret shoppers” are eligible for Card based consumer Sweepstakes, but not for Card-based employee Sweepstakes. This Sweepstakes is void where prohibited or restricted by law, and is subject to all applicable federal, state and local laws. Only retail outlets in participating Safeway Inc. Divisions (as defined above) are participating in the Sweepstakes.

8. Entrants, by their participation, and winners, in accepting their prizes, agree to indemnify and hold harmless and waive any and all claims of liability of any kind whatsoever against the Sponsors and/or the Sponsor Affiliates including any accident, loss, injury or death occurring or in any way related to the prizes or use/misuse thereof or while traveling to and/or from a location to obtain or use the prizes. Neither the Sponsors nor the Sponsor Affiliates make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any prize including, without limitation, quality, merchantability, and fitness for a particular purpose. Further, the Sponsors and Sponsor Affiliates shall accept no responsibility for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.

9. Winners, in accepting their prizes, consent to the use of their names, addresses (city, state), photographs and likenesses for purposes of advertising, trade and promoting in any and all media on behalf of the Sponsors, without further compensation except where prohibited by law.

10. To receive a winners’ list, mail a self-addressed, stamped envelope, by July 1, 2005, to: Safeway “Experience the Flavors of Chile” Sweepstakes Winners, 601 University Avenue #275, Sacramento, CA 95825.

11. The Sponsors of this Sweepstakes are Safeway Inc., 5918 Stoneridge Mall Rd., Pleasanton, CA 94588 and Chilean Fresh Fruit Association, 300 University Ave., Suite 207, Sacramento, CA 95825.
